§ 1 Scope / Contracting Parties
- These General Terms and Conditions and Customer Information apply to all contracts concluded by customers with us, Hagemann & Partner Verlagsgesellschaft mbH, Graf-Adolf-Str. 100, D-40210 Düsseldorf, via our online shop at www.hagemann.de. Any terms and conditions of the customer that contradict or deviate from our T&Cs shall not apply unless explicitly agreed otherwise.
- Customers are both consumers and entrepreneurs. According to §13 BGB, a consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed. According to §14 BGB, an entrepreneur is a natural or legal person or a legally capable partnership acting in the exercise of their commercial or self-employed professional activity when concluding a legal transaction.

§ 2 Ordering and Conclusion of Contract, Contract Language, Correction of Input Errors
- The presentation of products in the online shop does not constitute a legally binding offer but an non-binding online catalog. By clicking the "Buy" button, you place a binding order for the goods contained in your shopping cart (offer).
- You place an order in our shop by:
- adding items to the shopping cart,
- proceeding to "Checkout",
- entering your delivery and payment data,
- reviewing your entries on the order summary page at the end of the shopping cart process (here you can also correct entries by clicking the "back" button), and
- completing your order by clicking "Buy" and thereby submitting it to us.
- After submission, you will receive an automated email confirming the receipt of your order and listing its details (confirmation of receipt). If you choose PayPal, credit card, Apple Pay, or direct debit, the contract is concluded upon submission of the order. For other payment methods, the contract is concluded only when we accept your offer within five days via a separate confirmation email, payment request, or dispatch of the goods. The first alternative that occurs governs.
- The contract is concluded exclusively in German.
- You can correct input errors before submitting your order using the technical means provided in the online shop or standard keyboard/mouse functions. You can also cancel the process by closing the browser window. By clicking "Buy," you make a binding order; errors cannot be corrected afterward.
§ 3 Storage of Contract Text
The contract text is stored with us and sent to you immediately after submitting your offer, together with the Terms and Conditions by email. If you registered for a customer account before completing the shopping cart process, you can also access the contract text via "Your Account" as long as your account exists. Additionally, you can print the offer data immediately after submitting your order. Otherwise, the contract text is not accessible to you.
§ 4 Delivery Area and Customer Base
- We deliver only within Germany. Orders from other EU countries require a German delivery address. For delivery outside Germany (e.g., Austria, Switzerland, Luxembourg, Netherlands, Denmark...), please call our service hotline at Tel.: +49 (0)211 179270-60, available Mon-Fri, 08:00 – 18:00.
- Our goods are not intended for import into or use in the United States of America (USA). Corresponding orders will not be accepted.
§ 5 Prices and Shipping Costs
- All prices are total prices, including all price components and statutory VAT.
- In addition to the stated prices, we charge shipping costs per order as indicated in the respective product offer.
§ 6 Payment
We offer the following payment methods:
- Invoice (subject to creditworthiness):
Payment is due within 14 days from invoice date. Invoicing occurs with delivery. Delivery on account requires that all previous invoices are settled. For credit risk protection, we may require advance payment based on a credit check. Public institutions (schools, kindergartens, etc.) receive delivery on account without restriction. Consumers may order up to €79.00 on account, school addresses up to €300.00. Companies: first three deliveries in advance, thereafter up to €300.00 on account. - Direct debit (SEPA):
The debit from your bank account occurs 5 days after order completion. Advance notice is sent with the order confirmation. If the debit fails due to insufficient funds or incorrect bank data, the bank charges a fee, which we may pass on. - Prepayment:
Transfer details are sent after order via separate email. Shipment occurs 6–8 days after payment instruction. Reserved for 14 days from confirmation; payment must be made within 14 days. - PayPal:
Payment occurs via PayPal account. You must be registered with a linked credit card or bank account. During the order process, you are redirected to PayPal to authorize the payment. Payment is charged immediately to your PayPal account.
Other payment methods are processed by our PSP, Mollie B.V., Keizersgracht 313, 1016 EE Amsterdam, Netherlands. Selecting one of these methods redirects you to Mollie's page for the selected method to provide your payment information and confirm the transaction. More info: https://www.mollie.com/de/.
- Credit Card:
Mastercard and VISA accepted. We require card number, validity, expiration date, and security code. Your card is charged immediately after order submission. - Apple Pay:
Payment possible via Safari browser and Apple account with Apple Pay activated. Authorized immediately upon submission.
§ 7 Delivery and Delivery Times
- You will receive our package shipments via DHL or DPD. Delivery to DHL Packstations is possible. Smaller shipments up to 1000 g can also be sent as parcel post, letter post, and/or book mail via Deutsche Post. You will be notified once the shipment has left our premises.
- Unless otherwise agreed or indicated in the product description, we deliver within five working days after receiving your order.
- To ensure smooth delivery, we provide your email address and phone number to the respective shipping provider. If you disagree, you can object at any time via widerspruch[at]hagemann.de. More details are in our privacy policy.
- Obligation to deliver ceases if we are not properly or timely supplied ourselves, provided we are not responsible and have concluded a congruent coverage transaction with our supplier. In such cases, we will notify you immediately and refund any prepayments without delay.
- For consumers, the risk of accidental loss or deterioration passes upon delivery to the consumer or a recipient designated by them. For entrepreneurs, the risk passes upon handover or, in case of shipment purchase, upon delivery to the transport company.
§ 8 Infringement of Third-Party Rights, Right of Withdrawal, Indemnification
If you use our product customization service, you guarantee that the images, data, and content provided do not infringe on third-party copyrights, trademarks, or other rights and that you hold all necessary rights. We explicitly point out that we do not check this; it is your responsibility to ensure compliance before submission.
We reserve the right to reject orders or withdraw from the contract if it becomes known or reasonably suspected that third-party rights are violated through the submitted content.
If third parties assert claims against us for rights infringement, you must indemnify us on first demand and reimburse reasonable costs of legal defense.
§ 9 Right of Withdrawal for Consumers
§ 9.1 Withdrawal Instructions
If the customer is a consumer (according to §13 BGB), the following right of withdrawal applies:
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day you or a third party designated by you, who is not the carrier, take possession of the last item.
To exercise your right of withdrawal, you must inform us (Hagemann & Partner Verlagsgesellschaft mbH, Graf-Adolf-Str. 100, D-40210 Düsseldorf, Tel.: +49 (0)211 179270-60, Email: bestellung[at]hagemann.de) of your decision to withdraw by a clear statement (e.g., a letter sent by post or email). You may use the attached model withdrawal form, but it is not mandatory.
To meet the withdrawal deadline, it is sufficient to send your communication before the withdrawal period expires.
Consequences of Withdrawal
If you withdraw, we will refund all payments received, including delivery costs (except extra costs if you chose a different delivery type than the cheapest standard), without delay and at the latest within fourteen days of receiving your withdrawal notice. Refunds use the same payment method unless agreed otherwise; no fees will be charged.
For goods that can normally be returned by post:
We may withhold the refund until we receive the goods back or you provide proof of shipment, whichever is earlier.
You must return the goods within fourteen days of notifying us. The period is met if goods are sent before the fourteen days expire.
You bear the direct cost of return.
For goods that cannot normally be returned by post:
We will collect the goods. You bear the direct cost of return, estimated at max €150.
You are liable for any value loss only if it resulted from handling beyond what is necessary to check the goods.
§ 9.2 Exclusion of Right of Withdrawal
The right of withdrawal does not exist for contracts
- for delivery of goods not prefabricated and customized according to consumer specifications;
- for delivery of sealed goods that cannot be returned for health or hygiene reasons once unsealed;
- for delivery of audio/video recordings or software in sealed packaging once unsealed;
- for delivery of newspapers, magazines, except subscription contracts;
- for provision of digital content not on a tangible medium if you agreed to immediate fulfillment, acknowledged that withdrawal expires, and received confirmation.

§ 10 Information on Warranty Liability (Warranty and Guarantee)

- Our products are not intended for export or use in the USA. Deviations from US regulations are not considered defects under German warranty law.
§ 11 Applicable Law and Jurisdiction
- German law applies, excluding UN Sales Law (CISG), unless mandatory protections for the consumer's country of residence apply.
- If the customer is a merchant, public law entity, or special fund (§38 ZPO) and concluded the contract in that capacity, our local court is agreed as exclusive jurisdiction. We reserve the right to sue at another legal venue as well.
§ 12 Retention of Title
The delivered goods remain our property until full payment of the purchase price.

§ 14 Disposal of Electrical and Electronic Equipment
Due to the sale of electrical and electronic devices, we are obliged to inform you as follows:
All electrical/electronic devices intended for use in private households are marked with the symbol of a crossed-out wheeled bin as shown below.

The “crossed-out bin” symbol means: Electrical and electronic equipment must not be disposed of with household waste. They must be collected separately. Batteries, accumulators not enclosed in the device, and lamps that can be removed without destruction must be separated before disposal. You are responsible for deleting personal data.
According to §17 (1) and (2) ElektroG, we are obliged to take back electrical/electronic waste and implement it as follows:
1. When providing a new electrical/electronic device to an end user, we take back an essentially equivalent old device of the same category at the point of delivery or nearby free of charge. The pick-up is also at the private household if delivered there. Free pick-up is limited to categories 1 (heat exchangers), 2 (screens, monitors, devices with screens >100 cm²), and 4 (devices with at least one dimension >50 cm). Other categories (3: lamps, 5: small devices, 6: small IT/telecom devices) are returned via suitable collection points within reasonable distance. 2. On request, devices with all dimensions ≤25 cm are also collected free of charge via suitable collection points, limited to three devices per type. The collection is not tied to a new purchase. Collection points: [e.g. https://take-e-back.de].
Please ensure proper packaging when returning devices to prevent breakage. Acceptance can be refused if health and safety risks exist due to contamination. You are responsible for deleting personal data. Private households may also return devices free of charge at municipal collection points. § 15 Battery / Accumulator Disposal
Batteries must not be disposed of with household waste!

By law, you must dispose of batteries and accumulators (hereafter only "batteries") separately from other waste streams to enable proper treatment. Batteries contain toxic substances and recyclable materials. Proper disposal prevents environmental contamination and protects human health.

The “crossed-out bin” means batteries must be collected separately. Labels indicate:
Pb = more than 0.004% lead, Cd = more than 0.002% cadmium, Hg = more than 0.0005% mercury. Used batteries can be returned free of charge to public collection points or where sold. You may also return them to us:

§ 16 Alternative Dispute Resolution
We aim to resolve disputes amicably. We are not obliged to participate in a mediation procedure and cannot offer participation to customers.
